What is the General Data Protection Regulation (GDPR)?

If you have clients in the EU, it’s likely you’ve heard of the GDPR. With the excess of information, the fear campaigns, and the threats of hefty fines, understanding what it actually means for you and your business might seem daunting. The protection of personal data is more important than ever as businesses have greater access to potentially sensitive information on individuals. The data that businesses can now collect is not limited to name, gender, and contact information, but could include IP addresses and geographical information as well as biometric and genetic data.

In 2016, the European Union (EU) released the GDPR, with an implementation date of 25 May, 2018, to protect residents living in the EU, including permanent residents, visitors and expats.

Does the GDPR apply to your business?

It is important to understand that the GDPR does not exclusively apply to businesses located in the EU, but businesses that handle the data of EU residents.

This means, regardless of your business location, the GDPR applies:

  • If you promote goods or services to an EU citizen
  • If your company controls, processes or monitors personal data relating to an EU citizen
